DMCA Policy

ChefsPantry respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512, we will respond promptly to notices of alleged copyright infringement that comply with applicable law.

Filing a DMCA notice

If you believe that content available through ChefsPantry infringes your copyright, you may submit a written notification to our designated agent. Under 17 U.S.C. § 512(c)(3), your notice must include:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it.
  • Contact information for the complaining party, including address, telephone number, and email address.
  • A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

Counter-notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the district where your address is located (or Salt Lake County, Utah, if your address is outside the United States), and that you will accept service of process from the party who filed the original notice.

Upon receiving a valid counter-notification, we will forward it to the original complaining party and restore the removed material within 10 to 14 business days unless the copyright owner files a court action seeking to restrain the user from engaging in infringing activity.

Repeat infringer policy

In accordance with the DMCA, ChefsPantry will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances. We may also limit access to the service or terminate accounts of any user who infringes the intellectual property rights of others, whether or not there is a repeat infringement.

Good faith

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
